Breach of Tenancy Neighbour Disputes and Anti-Social Behaviour Every resident (owner or tenant) should be able to enjoy living in their home without nuisance or annoyance from other residents. When you signed your tenancy agreement, you agreed to certain things. These are the conditions of your tenancy which are intended to ensure that you and your neighbours can enjoy your homes and the surrounding areas in peace and comfort. Persistant Noise or Disturbance Too much noise from late night parties, music or household appliances can be annoying to neighbours, so please show consideration for others. You should be aware, that persistent complaints relating to anti-social behaviour of this type, could lead to the Association taking legal action against you. If you are experiencing this type of disturbance from your neighbours, it is important that you record the details and report it to either Renfrewshire Council’s Noise Enforcement Team or the Police in addition to your housing officer. It may be necessary at times to involve Renfrewshire Council's Mediation Team or their Anti Social Investigations Team. The Association can provide you with an Anti Social Behaviour Diary to assist you (available from our Download Section). A Council’s leaflet relating to their services for tackling anti social behaviour, can be obtained from our Download Section. If after investigation, either party to the dispute is found to be in breach of their tenancy conditions, the Association may take legal action which could ultimately result in an Order for Recovery of Possession or an Anti Social Behaviour Order being pursued. This action, however, would only be taken when all other efforts to resolve matters have been exhausted. Disputes Between You and Your Neighbour Disagreements with neighbours can be very difficult to resolve. Where a problem exists, you can help by keepin, as evidence, an accurate record of disturbances, as they occur. We would remind you that any nuisance in and around your home – whether caused by yourself, members of your household or visitors to your house – is a breach of your tenancy agreement. In these cases, we may take legal action against you. Renfrewshire Council provide the services of a Noise Enforcement Officer who can deal with noise problems as they arise. Harassment The Association takes any form of harassment, discrimination or aggravation seriously. We place great importance on tenants being able to live in their homes and communities, without fear of harassment. We will respond quickly to all allegations of harassment, which can take a number of forms, such as sexual, racial or religious. We will support victims of harassment by formally investigating any such report and will take any action necessary to stop the harassment. This could include initiating court proceedings for the eviction of any tenant carrying out harassment. It may also involve us considering rehousing those being harassed. In many cases, harassment can be illegal. Where necessary, we will work with the Police to ensure the appropriate legal action is taken, either by the Association or by the victim of harassment. Just as we take these matters seriously, we would ask those to whom we provide a service, to treat and talk to our staff with civility. The Association reserves the right to withdraw services to anyone who is abusive or acts in a threatening manner towards our staff. Any information you give us will be treated confidentially and no action will be taken without your agreement. If you are being harassed in any way you should record a complaint with the Police.
